TERMS OF USE OF BOOMS SERVICES AND APPLICATIONS

TERMINOLOGY
BOOMS Rewards Platform : The online application provided by "BOOMS I.K.E." - hereinafter BOOMS - based in Athens, Piraeus Street, no. 205, Postal Code 176 73, A.F.M 800690033, D.O.Y. A ATHENS, phone number 210 9931000, e-mail info@booms.gr, website www.booms.gr so that the Partner Businesses can provide Reward Programs to their customers.
Partner Businesses: Businesses/Merchants participating in the BOOMS Rewards Platform.
Reward Programs: The reward programs provided by Partner Businesses to their customers and specifically to Members/Users of the BOOMS Rewards Platform. More specifically, the Members/Users of the platform (customers of the Partner Businesses) collect Points every time they purchase products and/or services from the Partner Businesses and the Points collected can be redeemed by the Members/Users according to the conditions the Partner Businesses have defined, each for their own Rewards Program.
Member/User of the BOOMS rewards platform & DAY Mobile application: Any customer of the Partner Businesses who participates in the Rewards Program of one or more of the Partner Businesses.
Participation in the program means that the customer has: a) consented to voluntarily share/disclose at least his mobile phone number and name to one or more Partner Businesses and b) has accepted the Terms of Use of the BOOMS Rewards Platform
The Terms of Use are communicated to the customer via the www.booms.gr website and the DAY Mobile application (Android & iPhone).
The consent and acceptance of the Terms of Use by the Member/User is done in the following ways:
1. The first time the Member/User communicates their mobile phone number to a partner company, they receive a SMS text message to the mobile phone they notified, which, in addition to the registration instructions on the platform and the 4-digit Confirmation Code, also contains the relevant link with the Terms of Use on the website www.booms.gr.
Since the Member/User, receiving the SMS, chooses to register on the platform, it means that he has read and consented to and accepted the Terms of Use. To complete his registration, he must download the DAY Mobile application (Android or iPhone) and before completing his registration he has selected that he accepts the Terms of Use in order for the platform to allow him to complete his registration.
2. In the event that the Member/User is NOT able to complete his registration on the platform at the time he receives the SMS, if he has read and accepted the Terms of Use communicated to him via the SMS, he may ask an employee of the Partner Company to complete his registration on his behalf, in the Employee's System, notifying / informing the employee under his own sole responsibility, in addition to his mobile phone number, his name and the 4-digit confirmation code he has received by SMS to mobile phone that he disclosed to the employee.
In both of the above cases, if the Member/User does not complete his registration on the platform at the time he receives the SMS, he can continue to collect points (receive Points) every time he makes a transaction/purchase in one or more of the Affiliates Business, but will not be able to Redeem / receive Reward until he completes his registration on the platform.
In both of the above cases, the Member/User has:
a) on his own sole responsibility initially communicated his mobile phone number to the employee of the partner company,
b) has received an SMS with the relevant link to the Terms of Use, therefore the Terms of Use have been communicated to him and it is his decision and responsibility to choose to accept them and participate in the Rewards Program as well as to complete his registration on the BOOMS Rewards Platform.
Member/User Registration:
The registration of a Member/User on the BOOMS Rewards Platform can be done in the following 2 ways:
1. Through the DAY Mobile application or
2. Through a partner business.
In both cases, in order to complete the registration, the Member/User first needs to know the 4-digit Confirmation Code received by SMS. The 4-digit Confirmation Code is used for security and Member/User identification purposes.
After identification, the Member/User to complete the registration needs to share the following fields with the platform:
• Name - Mandatory
• Email – Optional
• Date of Birth – Optional
DAY mobile application: The mobile application (Android & iPhone), through which
the Member/User may:
1. To see in detail the points he has collected for each transaction/purchase at each Partner Business
2. To see the balance of points he has in each Partner Business
3. To see in detail the Redemptions he has made in each Collaborating Business
4. To see his account details and if he wishes to change them
a) First Name - Mandatory
b) Email – Optional
c) Date of Birth – Optional
5. To see Partner Businesses, their Reward Programs as well as any additional conditions set by each business
6. To receive updates from Partner Businesses
BOOMS Card : The card issued by BOOMS and distributed by Partner Businesses to their customers. The card bears the logo of the Partner Company and "BOOMS I.K.E." and its use shall be in accordance with the following terms.
This card is not a credit card. Intended for the exclusive use of its owner. Its use constitutes acceptance of the usage and privacy policy as applicable and published at www.booms.gr. If found please return it to BOOMS or another contracted company. For any information call us at 210 9931000
BOOMS Card Holder : the legal holder of the BOOMS card who has accepted the Terms of Use.
Points / Scoring: The mechanism of the platform through which Partner Businesses calculate the value of each Member's/User's consumption movement in order to Reward him/her for the frequent purchase/use of their products/services.
Reward/Redemption: The discounts (in % or euros) or goods, or services (or a combination thereof) provided by Partner Businesses to Members/Users as a reward for their frequent purchase and/or use of products and/ and services from them.
Terms of use
BOOMS TERMS OF SERVICE AND APPLICATIONS OVERVIEW
Participation in BOOMS services is voluntary and available to all individuals over the age of 18. Each Member/User represents and warrants that he/she has the required legal requirements, but also the ability to understand the terms of use listed below.
Each Member/User card is and remains the property of BOOMS and the Holder is obliged to return it if requested. In this case the Points will expire automatically and therefore will not be redeemable. The Holder is solely responsible for the use of the Card and BOOMS is not responsible in case of loss, theft or damage due to misuse. The Membership Card is strictly personal and cannot be transferred. The Membership Card is not a credit or debit card. The Holder with its appearance cannot make monetary transactions, except to enjoy Privileges. Under no circumstances can the Card, the number of Points and the right to a discount, gift or refund be returned for money.
The Member/User understands that BOOMS only acts as a technical supplier of the BOOMS Reward Platform and does not assume any responsibility for the Scoring and Rewards of partner businesses. Rewards/Redemptions are provided by Affiliates directly to Members/Users. The method of collecting and redeeming points may differ at each Partner Business. When a Member/User uses or obtains any of the Rewards provided by Partner Businesses, the provision thereof will be made in accordance with the terms and regulations of the respective Partner Business that offers it. Any details on the conditions for collecting and redeeming Points at each partner business are listed in the DAY Mobile application.
The only obligation of the Member/User of BOOMS/mobile DAY application in order to enjoy the Rewards of the Loyalty Programs is to present the personal Membership Card or report his mobile phone number to the employee of the partner business.
When presenting the Membership Card or mentioning the mobile phone number, BOOMS is under no obligation to carry out an identity check. The Member declares that the information that has been declared is complete and accurate and that in case he wishes to modify it, he assumes the responsibility to inform BOOMS immediately by calling it at 210 9931000 or to modify it by the Member/User himself through the Mobile application DAY.
If the Member/User does not wish to participate in the program and in addition his details are not available on the platform, he must contact BOOMS at 210 9931000 or at info@BOOMS.gr or through the DAY Mobile application and declare this in order for all his details and his account to be deleted from the BOOMS Rewards Platform
The Privileges are provided to the Member/User for as long as the BOOMS services and Reward Programs are in force. BOOMS and Partner Businesses reserve the right to modify these terms at any time, without notice to Members/Users. Modifications, additions or deletions to the terms and conditions take effect immediately from their posting on the DAY Mobile application as well as on the www.booms.gr website. By using the BOOMS services, you expressly accept the changes, modifications, additions or deletions. For this reason, it is recommended to read the Terms of Use at regular intervals, in order to have safe and timely information about any changes in their content. The date of the last modification of the terms will be posted each time at the beginning of the page.
CONTACT
BOOMS reserves the right to regularly inform Members/Users via e-mail, mobile phone message (SMS) or any other means. The update is related to Partner Businesses, products, services, offers and reward of Members/Users and is done only through BOOMS. If the Member no longer wishes to receive promotional and informational material, they can modify their preferences in the DAY mobile application or inform BOOMS by calling 210 9931000.
COPYRIGHT
The content of www.booms.gr as well as the DAY mobile application is the intellectual property of BOOMS. Any information (text, images, graphics) contained on the www.booms.gr website and in the DAY mobile application can only be used for personal, non-commercial use. It is illegal to copy, reproduce, modify in any way, part or all of the contents of the www.booms.gr website and the DAY mobile application without the prior written consent of the BOOMS company.
All trademarks, logos, service marks, company name, distinctive title, photographs, graphics, distinctive features, texts, the Membership Card, its management applications and everything else contained on the website www.booms .gr and the DAY mobile application are the intellectual property of BOOMS. The user/visitor is prohibited from copying, reproducing, disseminating, making available, transmitting or using them, beyond the uses expressly defined on this website.
PRIVACY POLICY
By registering for BOOMS services, the Member/User gives his consent to BOOMS to use his personal data in accordance with the BOOMS Privacy Policy, which he unconditionally accepts.
LIMITATION OF LIABILITY
BOOMS bears no responsibility for the acts or omissions of Partner Businesses and does not participate in any way in the transactions carried out. Its responsibility is limited to its role of promoting the Affiliate Business Reward Programs through the DAY mobile application as well as through its social media accounts (Facebook, Instagram, Google, etc.). BOOMS bears no responsibility in the event that the Partner Businesses break any promise for a gift, discount, gift certificate or fail to comply with the procedure for collecting and redeeming Points, or omit, or delay, or inform it incorrectly about the collection or redemption of Points by the Member /User. BOOMS bears no responsibility for any damage or loss, direct or indirect, resulting from the provision or non-provision of a Reward, or from the termination or modification of the terms of the Reward Programs by the Partner Businesses.
Communication with third parties: BOOMS has no responsibility for the Member/User's communication with third party service providers who may advertise or display their website link on www.booms.gr and the DAY mobile application and for any commercial transaction that may arise from the relationship between them. BOOMS does not control the availability, content, privacy policy, quality and completeness of the services of other web sites and pages to which it refers through "links", hyperlinks or advertising banners. Therefore, for any problem that occurs during their visit or use, the user must contact the respective websites and pages directly, which bear full responsibility for the provision of their services. BOOMS should in no way be considered to endorse or accept the content or services of the websites and pages to which it refers or to be connected to them in any other way.
Website and application contents: BOOMS ensures the proper functioning of the website and the accuracy of its content as well as the proper functioning of the BOOMS Rewards Platform. However, given the nature and volume of the internet, BOOMS assumes no responsibility for the timeliness, correctness, completeness, legality and quality of information of content on its website. It is not responsible for any form of damage suffered by the visitor/user of the BOOMS pages, services, applications and contents which it does on its own initiative and under no circumstances can it guarantee that the site will not be infected by viruses or other harmful components.
The contents of www.booms.gr and the DAY mobile application are provided "as is". BOOMS DOES NOT WARRANT THAT THE PAGES, SERVICES, OPTIONS AND CONTENT WILL BE PROVIDED UNINTERRUPTED, ERROR-FREE AND THAT ANY ERRORS WILL BE CORRECTED. The cost of possible corrections or services is borne by the visitor/user and under no circumstances by BOOMS. BOOMS is not responsible for covering the claims of third parties due to their misrepresentation, due to copying, falsification of the page or usurpation of part of it by unauthorized third parties, who carried out the above actions in violation of the Company's intellectual and industrial rights and user morals.
Force Majeure: BOOMS bears no responsibility for damage or damage, direct or indirect, resulting from the non-fulfillment of its obligations for reasons beyond its/force majeure's control. If parts or individual terms of this statement cannot be regarded as legally correct, the content or validity of the other parts remain unaffected.
The above terms and conditions of use of the BOOMS pages, services and applications, as well as any modification thereof, are governed and supplemented by Greek and European law, while any disputes arising in relation to the specific terms and conditions belong exclusively to the jurisdiction of the courts of Athens.
This constitutes the entire agreement between BOOMS and the Member/User of the BOOMS Rewards Platform. No modification of these terms shall be considered and shall not form a part of this agreement unless made in writing and incorporated herein. BOOMS reserves the right to modify these terms and these changes will be considered effective immediately from the moment they are published on www.booms.gr and on the DAY mobile application.
Privacy Policy - Personal Data Management
COLLECTION AND SECURITY OF PERSONAL DATA
We collect your personal information through registration on the BOOMS Rewards Platform or the DAY mobile application. Your personal data is collected by BOOMS, stored securely and kept confidential in accordance with the new General Data Protection Regulation (GDPR) and the relevant legislation.
DATA PROCESSING AND PURPOSE OF DATA PROCESSING
The processing of personal data of Members/Users of the BOOMS Rewards Platform is done carefully and only by BOOMS. These are collected for the purpose of informing Members/Users of the BOOMS Reward Platform about partner businesses, their products, services, offers and rewarding them through Partner Businesses. In addition, the personal data of the Members/Users of the BOOMS Rewards Platform is processed for the purpose of managing the clientele of the Affiliated Businesses. The data of Members/Users of the BOOMS Rewards Platform is collected in order for BOOMS and Affiliated Businesses to serve you in the best possible way, to assess your needs for more products and services.
As a Member/User of the BOOMS Rewards Platform you reserve the right to change your preferences for the updates you receive or to request the cessation of sending informative actions at any time.
ACCEPTANCE OF PRIVACY POLICY
By accepting this Privacy Policy, the Member/User of the BOOMS Rewards Platform accepts that BOOMS may collect and process their personal data. In addition, through the acceptance of this Privacy Policy, the Member/User accepts the customer reward services provided by the partner businesses using the BOOMS Rewards platform, as well as the information actions concerning these businesses, and are carried out exclusively and only through BOOMS.
DATA GRANT
BOOMS does not share or provide the personal data of Members/Users of the BOOMS Rewards Platform to third parties. Partner businesses have access to the information that Members/Users of the BOOMS Reward Platform voluntarily provide, for the sole purpose of scoring and rewarding them. The information actions carried out on behalf of the cooperating companies are done through BOOMS for the purpose of commercial communication with BOOMS Members/Users.
NATURE OF PERSONAL DATA
The personal data that the Member/User voluntarily provides to BOOMS is primarily the mobile phone number and then the name, and optionally the email address and date of birth.
The Member/User guarantees that the personal data he provides is not false and undertakes the responsibility to inform BOOMS of any modification thereof. BOOMS reserves the right to exclude from its services any Member/User who has provided false data or has deviated from the Terms of Use. We invite Members/Users to be particularly careful with Personal Data Protection issues as BOOMS assumes no responsibility for illegal losses, modifications or even theft of personal data.
RIGHTS OF ACCESS, CORRECTION, CANCELLATION AND OPPOSITION
The Member/User always reserves the right to address BOOMS by exercising the right of access, rectification, cancellation and opposition, by phone at 210 993100, Monday to Friday 9:00-18:00 and via e-mail at info@booms.gr. In order to exercise these rights you will need to certify your identity by sending a photocopy of your police ID card or by any other means recognized by Law. BOOMS guarantees the execution of all rights of the Member within 72 hours.
POLICY CHANGES
BOOMS reserves the right to revise the Privacy Policy whenever it deems appropriate. For this reason we invite Members/Users to regularly check the Privacy and Personal Data Management Policy so that you are always up to date on the latest version.
ACCEPTANCE AND CONSENT
The Member/User declares that he has been informed of the terms of use and the personal data protection policy by BOOMS, accepts it and gives his consent to its electronic processing by BOOMS, in the manner and for the purpose described in this Privacy Policy.
